CBD products are everywhere now. You can pick up oils, tinctures, gummies, and creams at your local drugstore. Most people assume these products are completely safe and legal. They are, for the most part. But there’s a catch that catches many users off guard.
Using CBD might land you in legal trouble if you’re pulled over while driving. Our friends at Eastside DUI work with clients all the time who never imagined their CBD routine could lead to impaired driving charges. An impaired driving lawyer can walk you through your options if you’re facing allegations related to CBD or other substances.
Understanding CBD And THC Content
CBD won’t get you high. It doesn’t impair your driving ability. So what’s the problem? The issue is what else might be lurking in your CBD products. Full-spectrum CBD contains trace amounts of THC, which is the compound in cannabis that actually causes intoxication. Federal law permits CBD products to have up to 0.3% THC. That percentage seems tiny. But if you’re using these products regularly, THC can build up in your system over time. Some products labeled as THC-free still contain small amounts. Manufacturing inconsistencies happen. Quality control isn’t always rigorous. Sometimes labels are incorrect, or products become contaminated during production.
How Drug Tests Detect THC
Law enforcement might request a blood or urine test if they suspect you’re driving impaired. These tests can’t tell the difference between THC from marijuana and THC from your legal CBD oil. They just detect THC metabolites in your body. Blood tests measure active THC in your system right now. Depending on where you live, even very low levels could create legal problems for you. Urine tests are different. They pick up THC metabolites that stick around for weeks, long after any impairing effects have disappeared completely. Here’s where things get frustrating. These tests can’t actually prove you were impaired behind the wheel. They only show you consumed something with THC at some point recently.
Getting A DUI From CBD
If your drug test comes back showing THC after you’ve been using CBD products, charges might follow. That doesn’t guarantee a conviction, but you’ll need to mount a defense. Officers watch for impairment signs during traffic stops. Slurred speech. Bloodshot eyes. Unusual behavior. If they think you’re under the influence, they may arrest you regardless of what you actually took. Explaining that you only used legal CBD products won’t necessarily stop them from filing charges.
Protecting Yourself As A CBD User
You can take steps to reduce your risk if you use CBD and drive regularly:
- Buy CBD isolate products with zero THC content
- Stick with reputable brands that provide third-party lab testing
- Save certificates of analysis that verify THC levels
- Don’t use CBD right before getting behind the wheel
- Learn your state’s specific THC limits and DUI regulations
Product labels require careful reading. “Hemp-derived” isn’t the same as “THC-free.” Look for products specifically marked as CBD isolate or broad-spectrum with verified zero THC. Third-party testing matters more than marketing claims.
What To Do If You’re Charged
Getting charged with impaired driving after using CBD feels incredibly unfair. You bought a legal product. You weren’t trying to break any laws. Unfortunately, your intentions don’t automatically protect you from prosecution. Save everything related to your CBD use. Receipts, packaging, and lab reports. All of it could help your defense later. Don’t explain your CBD habits to police without representation present. You might think you’re clearing things up. Instead, you could be creating evidence that works against you.
Understanding Your Legal Options
No two impaired driving cases look exactly alike. The THC amount detected matters. So does the way the test was administered and whether officers had valid reasons for the stop in the first place. You can challenge both the evidence and the procedures used during your arrest. CBD legality and DUI laws don’t always mesh well together. That creates confusion for many people who thought they were doing everything right. If you’re facing charges tied to CBD use, getting legal help early can dramatically change how your case unfolds.

Posted on AnonymousTrustindex verifies that the original source of the review is Google. I was facing a charge of Reckless Driving for speeding on I66 at midnight. This is considered a Class 1 Misdemeanor in the state of Virginia. Having something like Reckless Driving on your record is on par with having a DUI. This charge also carries a chance for jail time (up to a year). I was incredibly scared because I had never faced such a charge. And looking into Virginia Law, my speed exceeded 90mph, which is quite serious. I retained Dave Albo to help me with this case. Since my record was clean, Dave had advised I do the following before my trial. * Take a DMV Driver's Improvement Course * Take a Behavior Modification Course * Do 100 hours of community service * Print my DMV Record one week before the trial On the day of my trial, Dave got my Reckless Driving charge REDUCED to a regular Speeding charge. This was the absolute best case scenario for me. No criminal record. No jail time. No suspension of license. I did receive 6 demerit points and had to pay a fine of $250 (plus court fees). But that's a slap on the wrist, compared to what I could have been facing. Thank you Dave Albo for helping me through this ordeal!Posted on TomTrustindex verifies that the original source of the review is Google. Dave albo it's a fantastic lawyer. Dave was my attorney recently for a car accident where I needed someone to represent me in court. After exchanging all necessary information he reassured me when the court date came that there wouldn’t be anything to worry about. On the day of court a couple problems arose and Dave was able to rectify them quickly, told me everything I need to say if needed and when it was all over he got my violation reduced significantly. I hope to never go to court again but if I do I will being calling Dave again.Posted on Amanda StallardTrustindex verifies that the original source of the review is Google.
