Types of Fraud
Fraud is a relatively broad term that can encompass a range of financial scams.
Common forms of fraud that may warrant the help of an embezzlement lawyer may include:
- Fake Internet Seller: If you notice a high-value item listed online for a suspiciously low price, chances are the seller is running a scam. The seller will accept your money, and you will never receive the product.
- Website Misdirection: Hackers may attempt to redirect the website during e-commerce checkout to steal your credit card information. Typically, victims start shopping on a legitimate website, but when they proceed to checkout, they are redirected to a fraudulent site. Be sure to verify the URL when checking out and examine the extension.
- Fake Checks: This form of fraud may be less sophisticated than internet fraud, but it can still be an effective scam. Individuals will write checks without sufficient funds in their accounts.

Embezzlement and Fraud Charges Explained
In our experience, most people charged with embezzlement are those who NEVER thought they would be charged with a crime. Some case examples include:
- A defendant worked at a company and used company funds to pay for personal items – something others in the firm did all the time.
- The partners all agreed that it was okay to use company funds for personal items. Then, suddenly, one of the partners changed his mind about that and called the police, alleging that the defendant was using company funds for his own personal benefit.
- A defendant borrowed money from his company, knowing he would repay it in a month. He fell on hard times and could not pay it back.
- Sometimes people get crossed wires with their boss. The next thing they know, they are accused of embezzlement or fraud for doing their job the same way they have done for years.
Many of these people have never broken the law before and never thought they would ever be charged with a crime.
To prove embezzlement, the prosecutor must prove (1) that the defendant wrongfully and fraudulently took property; (2) that the property had been received by the defendant by virtue of his employment; and (3) that the value of the property was $200.00 or more. The maximum punishment is up to 20 years in prison. If the value of the property is below $500.00 (on July 1, 2020 new legislation raises this level to $1,000) the crime is a misdemeanor and the maximum punishment is up to 12 months in jail and a fine of up to $2,500.00.
The prosecutor proves the case by establishing that each element above is proven beyond a reasonable doubt. Our Fairfax, VA embezzlement lawyer can present arguments to the court to discredit the police’s account or to argue that there are reasonable explanations for it.
Typically, it is uncommon to receive prison time for property crimes (e.g., larceny). When the General Assembly eliminated parole in 1994, it established guidelines to keep people out of prison for property crimes. That way, the state would have prison space for violent crime convicts. However, embezzlement can be an exception.
Prosecutors often seek jail or prison when a defendant embezzles money from a person who entrusted him with their money, for example:
- An employee embezzles from his or her employer
- A deacon embezzles from the church
- Someone who volunteers to do the books for a charity takes money from that charity
Especially in situations like these, you would want to work with an experienced embezzlement attorney. This is because not only is one looking at a felony, but one could also face prison time.
In many embezzlement cases, there will be an opportunity to “settle” the matter without a charge being filed. Working with our Fairfax, VA embezzlement lawyer before being served with charges may help negotiate a deal with the complaining witness (e.g., an employer or charity) without involving law enforcement.

Posted on AnonymousTrustindex verifies that the original source of the review is Google. I was facing a charge of Reckless Driving for speeding on I66 at midnight. This is considered a Class 1 Misdemeanor in the state of Virginia. Having something like Reckless Driving on your record is on par with having a DUI. This charge also carries a chance for jail time (up to a year). I was incredibly scared because I had never faced such a charge. And looking into Virginia Law, my speed exceeded 90mph, which is quite serious. I retained Dave Albo to help me with this case. Since my record was clean, Dave had advised I do the following before my trial. * Take a DMV Driver's Improvement Course * Take a Behavior Modification Course * Do 100 hours of community service * Print my DMV Record one week before the trial On the day of my trial, Dave got my Reckless Driving charge REDUCED to a regular Speeding charge. This was the absolute best case scenario for me. No criminal record. No jail time. No suspension of license. I did receive 6 demerit points and had to pay a fine of $250 (plus court fees). But that's a slap on the wrist, compared to what I could have been facing. Thank you Dave Albo for helping me through this ordeal!Posted on TomTrustindex verifies that the original source of the review is Google. Dave albo it's a fantastic lawyer. Dave was my attorney recently for a car accident where I needed someone to represent me in court. After exchanging all necessary information he reassured me when the court date came that there wouldn’t be anything to worry about. On the day of court a couple problems arose and Dave was able to rectify them quickly, told me everything I need to say if needed and when it was all over he got my violation reduced significantly. I hope to never go to court again but if I do I will being calling Dave again.Posted on Amanda StallardTrustindex verifies that the original source of the review is Google.
